SUBPOENAS - a subpoena issued in another state to be served process in Texas must be "domesticated". A domesticated subpoena is a subpoena that has been issued by the State of Texas. For an out of state subpoena to be effective, an attorney in Texas should be consulted in an effort to have the subpoena issued by the State of Texas. If the subpoena has not been domesticated, then it may not be enforceable.
With many counties in Texas requiring e-Filing, we are getting more and more service documents via email and fax. It makes the process quite efficient especially for out of state or out of county clients. We receive the service documents via email with the client retaining the original copies of all the paperwork. We pursue and complete service of process. We email the affidavit, then send the original in the mail and the client can pursue filing the return. Fast and efficient!
